Terms and Conditions

****General****
 

These terms and conditions (“Online Store Terms”) apply to all transactions concluded with you, the customer, when you shop via the DESIGN MY FABRIC website (“the Website”) and the online store. Please read them carefully before placing your order and print a copy for your future reference. By registering at the online store you accept and agree to be bound by the Online Store Terms and the terms and conditions of the Website (“Website Terms”) which together shall constitute the entire agreement between you and DESIGN MY FABRIC STORE (“DMFS”).

 DMFS reserves the right to alter these Online Store Terms from time to time.

The Online Store Terms are subject to Indian Law and the exclusive jurisdiction of the Indian courts. If any Online Store Terms shall be deemed unlawful, void or for any reason unenforceable then that Online Store Term shall be severable and shall not affect the validity and enforceability of the remaining Online Store Terms.


****Acceptance of orders ****

DMFS are only able to take orders through the online store for delivery to the countries listed on the checkout pages. If the country that you require delivery to is not visible then DMFS will not be able to process your order. 

DMFS validate your order and credit or debit card details you submit to us before your order can be accepted. Once that has been done, DMFS will confirm that your order has been received by sending an e-mail to the e-mail address you provide in your registration form. Our confirmation of your order brings into existence a legally binding agreement between us. 

DMFS accept all orders for products and services subject to availability and certain security checks. 

DMFS accept payment by most major credit and debit cards. Payment will be debited from your account before the dispatch of your purchase. All credit and debit card holders are subject to validation checks and authorisation by the card issuer and secure payment processor.  DMFS will not be liable for any delays to your order this may cause. If the issuer of your payment card refuses to authorise payment to us or you fail our security checks, DMFS will not be liable for any delay or non-delivery.

****Availability of Products****

If online store products become temporarily unavailable, DMFS shall hold your order until DMFS has the product back in stock and will then mail the product to you in the usual way. In the event that an individual product becomes permanently unavailable then DMFS will seek to offer you a suitable alternative or give you a FULL REFUND.


****Colour reproduction ****
 
DMFS has made every effort to reproduce colours in the online store as accurately as possible. However, different computers reproduce colours in slightly different ways, and so exact colour matches are not yet possible over the internet. This means that when you order products from the online store, colours may differ from what you see on the screen. If you are not satisfied with the colour of the product you have ordered, DMFS operate a returns policy (see "Returns Policy" below).



****Products and Pricing****

All product prices include Value Added Tax (“VAT”) where applicable. These may change in line with INDIAN government, Customs and Excise, directives, and other legal interpretations issued by relevant authorities. Promotions and prices you see in other stores and catalogues do not necessarily apply to the online store, and vice versa. 

 Import duties and local taxes are NOT included in the quoted price of goods being delivered to outside the INDIA. You will be responsible for the paying of any and all import duties and local taxes including any administration charges upon receipt. 

 DMFS reserve the right to amend any prices without any prior notice and at any time and the right to add or withdraw any product at any time.



****Delivery****

Your order will normally be dispatched within 15 (fifteen) working days of placing the order. Whilst DMFS make every effort to deliver goods within such timescales, however, some delays are inevitable. DMFS shall not be liable for any delay that you may suffer in this regard. If you would like to view the status of your order please visit ‘Order History’ in the ‘My Account’ section of the online store. If, after checking your Order History, you have any questions about the status of your order then please refer to our help section, accessible from the foot of every page. 

 DMFS are authorised to share your personal information with third parties who are used to fulfil your order or satisfy our obligations to you.

 
****Cancellation/Returns Policy****


DMFS have the right to cancel any order you make for any product if you fail our validation or security checks. In certain instances you may not receive email confirmation of an order being cancelled.  If payment has been processed you will receive a full refund.  
 

You have the right to cancel any order you make for any product purchased through the online store for a full refund. If for any reason you are not satisfied with your purchase, return it to us within 14 (fourteen) days of receipt in an unworn/unused condition for a full refund or exchange. When returning products to us for refund or exchange, you must pay for the appropriate postage costs. 

Within 14 days of purchase, you may return any product ordered from our online store. Returned products must be in their original packaging with all instructions and warranty cards. All products must be complete and undamaged. Disassembled, damaged, and custom products cannot be returned. If the return is due to an error by us, we will credit you for the return postage or freight, otherwise you are responsible for the return postage or freight.

Please wrap products securely, fix the returns label safely to the parcel and attach appropriate postage.  Please remember to include your completed returns form and give the reason for return and any new requirements.  DMFS advise that returns are sent recorded delivery via Registered Mail as DMFS will not accept liability for lost returns.  Should you have any queries regarding a return then please refer to our help section.

 

****Personalisation****

 DMFS do not accept any responsibility for the impairment to product during postage. DMFS will not accept any returns or refund requests outside of our normal returns policy & also if no relevent reason of return is found.


****Your Rights****
 
The above terms do not affect your statutory rights.

****Third Party Rights****


The Online Store Terms are not intended to give rise to any right which is enforceable by a third party by virtue of the Contracts (Rights of Third Parties) Act 1999.
